Understanding Martyn’s Law: Implications for Key Management in Universities

In public safety, preparedness is essential, especially in large-scale campus sites as critical as universities. The impending legislation known as Martyn’s Law, formally the Terrorism (Protection of Premises) Draft Bill, marks a significant step towards enhancing safety measures in public spaces and learning environments.

What is Martyn’s Law?

Currently in public consultations, Martyn's Law aims to mitigate risks and improve responses to terrorist attacks on various public premises. For universities, this means implementing measures that can effectively protect students, staff, and visitors in the event of an emergency.

Key Requirements Under Martyn’s Law

The legislation introduces differentiated requirements based on the capacity of premises:

  1. Standard Tier (100-799 capacity): Locations falling within this tier must adhere to specific regulations, including completing a templated Emergency Action Plan provided by the Home Office. These plans will guide the implementation of proportional security measures tailored to the assessed risks.

  2. Enhanced Tier (800+ capacity): Premises with capacities exceeding 800 people face more stringent demands. They are required to conduct detailed risk assessments, develop comprehensive security plans, and provide extensive staff training to ensure preparedness for potential threats.

  3. Exclusions: Premises with fewer than 100 people are exempt from the law's provisions, although adopting best practices in security remains encouraged.

Regulatory Framework and Compliance

Under Martyn’s Law, a robust inspection regime will be established by the UK Government. Regulators will possess full powers of entry into qualifying locations to ensure compliance. Non-compliance may result in fines, closure orders, or even legal prosecution, underscoring the importance of adhering to these new standards.

Universities and colleges, as expansive campuses hosting diverse activities, fall within the scope of Martyn’s Law. This includes academic buildings, student accommodation and sports facilities, alongside cultural venues such as museums and galleries.

Institutional Response and Preparedness

In response to Martyn’s Law, expected to become law imminently, universities and colleges are taking proactive measures to enhance their security protocols, including setting up dedicated groups to assess the implications of the legislation, develop consistent approaches, and leverage resources efficiently.

One element highlighted in the preparedness stage is the loss of control over keys, from identification and tracking to unaccounted access points.  This has the potential to leave sites vulnerable and in a state of emergency, difficult to shut down.

Traka is working closely with universities to support the design of key management solutions to ensure the complete security of campus at all times.
